L1: 72q2I have been receiving SEPP payments from a non qualified annuity since 1999.The IRS now want’s to charge me the 10% early withdrawl penalty. This is because the insurance co.’s 1099R box seven has a1 instead of a 2.They claim since the IRS has been ambiguous on 72q that’s all they will furnish. L2: 72q2I”m surprised that they waited this long. First step is to contact your accountant/tax advisor and get his/her advice.
One thing for sure, you should also find any and all documentation regarding your SEPP – especially dated material and evidence that the plan was in compliance when it was implemented and that the plan was followed from 1999 forward.
