L1: Private Letter Rulings after 1/1/2003Can anyone tell me if a Private Letter Ruling would go through, requesting a 6% assumed rate of return. In fact in a recent PLR (200313016) the IRS again referenced the mid term rate – see the article at http://72t.net/MN_ArticlesShow.aspx?WA=40in what looks like an extension of 2003-62 to non-tax qualified annuities.

Genrally I am going to agree with Gordon. To simply “fly in face” of the ruling by requesting a 6% interest rate assumption is likely to fail. Instead, I would look for more innovative methods/solutions to get to the annual distribution amount that is more to your liking. Much of this will dpeend on your specific facts & circumstances.
