L1: Additional Questions / Clarification on SEPP PLan1. Would it be acceptable for me to begin my SEPP Plan on November 2nd, 2005 and use September 120% midterm rate of 5.04%? It my understanding that I would not be allowed to use Novembers” 120% midtermrate which is 5.09% as theguidelines call for the previous 2 months as the basis for calculating.
2 In the annual recalculation on January of each year,is itacceptable touseNovember orDecembers” previous years 120% midterm rate?
3. Clarification: If I begin my SEPP distribution on November 2nd, 2005 and make two equalmonthy distributions (Annual gross divided by 12 months), itis acceptable to recalculate the 2006 and subsequent years based on December 31st of the previous year.

L2: Additional Questions/Clarification on SEPP PLanI suggest that you re-read the previous PLRs and discuss with your tax advisor – each of the previous PLRs is based on a particular set of facts and circumstances – try to follow the logic of the previous rulings.
Your questions are getting very specific – the only way to get an exact answer to an exact situation in advance is to request a PLR from the IRS.
