Disability and 72t rules

L1: Disability and 72t rulesThe SSA has declared me disabled because of heart disease as well as degenerative disk disease in my back. They put my disability onset date prior to the start of my IRA distribution under rule 72t. In the notice of award the SSA used the same wording as the IRS does, that is that the disability will last longer than 12 months or result in death. My question is am I released from the IRA rules and can I now access my IRA as I see fit?Regards,Larry Bucknum2002-09-22 06:03, By: Larry Bucknum, IP: [127.0.0.1]
L2: Disability and 72t rulesThe short answer is YES, immediately. Commencing in 2002 you should have your custodian put a “3” in box 7 of your 1099R; if not, file form 5329 putting a “03” on line 2. All of this is simply to make it clear to the IRS that you are now taking distributions subjct to the disability exception.TheBadgerwjstecker@wispertel.net2002-09-22 09:08, By: TheBadger, IP: [127.0.0.1]
