RMD – Divorce –

L1: RMD – Divorce – Have a client getting a divorce. Must give wife assets from his IRA’s. He is 52 years old. He currently has 2 IRA’s. From IRA #1, we reset his SEP to RMD in 2004. We are not taking any 72t from IRA #2 at this point.
If we reduce his IRA #1 significantly (this IRA would be the most beneficial place to give her assets from), I am assuming that his RMD would be calculated on this new lower value. Is this correct? That is not a problem. He no longer needs a distribution from this IRA anyways. Are there any “rules” here I’m not aware of? Thanks for your help2004-12-09 09:35, By: Kim, IP: [12.31.97.34]

L2: RMD – Divorce – There are several PLRs dealing with divorce and SEPPs – take a look through our FAQ – if you don’t find what you are looking for, Bill Stecker’s book is also an excellent resource.2004-12-09 17:53, By: Gfw, IP: [172.16.1.70]
