L1: Changed date of Monthly Distribution Rec”d 13 PI am 59 years old and started my 72(t) distribution in May 2002. I have been receiving monthly distributions of $2,004. In March of 2004, I decided to change the date of my monthly distribution from the 1st to the 20th. I received a payment on March 1st and then I received a subsequent payment on March 20th. I then received payments on the 20th of the month through December. This resulted in my receiving 13 payments for 2004. Here is my question:
1. Is my 72(t) busted?
2. Since my original distribution did not begin until May 2002 and I have always received monthly payments, is it possible that my payments run from May – April instead of on a calendar year basis?2005-04-11 13:29, By: Kathy, IP: [70.60.29.10]

At the moment your SEPP plan is busted; however, all is not lost. Although heavily fact & circumstance & intention driven, Rev. Proc. 2003-16 can be used to stretch the traditional 60 day rollover window to proivide you the time to put back that extra 13th monthly distribution. I would suggest you do that now; e.g. didn’t you just discover it??? and then make the RP 2003-16 submission. Cost of filing is $95 plus some professional fees, probably less than $1000,to get the submission done correctly.

Correct, all SEPP plans are now calendar year only.
