L2: SEPP and divorceHello Judy:Let’s take an example where A & B are married & A is taking SEPPs from his IRA. A & B divorce and as part of the divorce decree, the judge signs a QDRO (qualified domestic relations order) assigning/transferring 1/2 the value of A’s IRA to B. Results:1. B is under no obligation to do anything; she may start a new SEPP program with all new assumptions or she may choose to do nothing.2. A must continue the SEPP program from his IRA and may do so: (a) exactly as before; (b) exactly 1/2 of whatever was being done before; e.g. a prorata reduction in the SEPP amount equal to the division of the corpus.The above is very clear & is supported by 1/2 dozen or more rulings.
